In the following study some of the disputed aspects of the penal responsibility applyness for the hooliganism deed are examined. Through this, an attempt is made to increase to the respective application a unitary character, in the way to respect the legality principle. It is argued that the hooliganism offence always assumes public involving situation. But only in few cases is undertaken in public places. Also, it is demonstrated that the „private reason” notion, cannott be reduced to a „vengeance reason” notion level, being urged by the hostility between the offender and the offended. At the same time, it is recommended that the „vengeance reason” notion should not be confused with the „hooligan reason” notion. On the other hand, for example, a private reason can be considered, the work or public obligations agreement distortion from the offender.
