Family always has been and remains the main pillar of the society. The state and society support, through various methods, the development and strength of the family. Personal and patrimonial relationships between spouses is of great importance both for themselves, and for their infant children, and respectively for the society, because, especially in family, private interests are combined with the public ones and form the essence of the society. In case of appearance of litigation, legislation permits spouses to solve all the problems of the family life amiably, because only in such a manner can be the fullest satisfied interests of all the family members and of the society in general. The aim of jurisprudence is to settle the form and essence of the agreements that can be concluded between spouses. In this article the author analyses the juridical nature of the agreements permitted by law, that can be concluded by spouses in case of divorce. These are arrangements concerning separation of the common joint property of spouses, payment of the alimony on infant children or for invalid spouse that needs material support, determine the parent with whom the infant children will live after divorce. What is the juridical nature of these arrangements: are they pure family agreements or are they part of the civil contracts, or are some sui generis agreements, this is the key of the article.
