This article related to the means of protection of industrial property, especially to the protection of inventions by Supplementary Protection Certificate (SPC). This article highlights the importance of protecting Industrial Property Objects by Supplementary Protection Certificate, the benefits of this protection, the state of affairs regarding the protection of inventions by SPC abroad and in the Republic of Moldova. It also describes the objects and the modality of protection by SPC, cases when it can be revoked, damages caused by counterfeit products protected by SPC. In addition it describes the modalities of counterfeiting and makes a legal-criminal analysis of the offense of counterfeiting goods protected by SPC, and also makes proposals to improve legislation on the protection of industrial property objects. |
