The present article tackles the problems of the tentative and participation in the context of the establishment of penal responsibility for the offences related to crediting. Through thorough analysis the author concludes that the offences stipulated in the art. 238 and art. 239 of the Criminal Code of Republic of Moldova are susceptible of phases in their execution, therefore they are susceptible of tentative. Both, the obtaining of the loan by means of deceit and the violation of the crediting rules are offences with intention, so, the examination of the participation problems of these offences carries a special scientific interest |
