A new view on the notion of „hooligan intentions” is presented in the article. The notion of „hooligan intentions” is used in art. 145, 151 and 152 of the Criminal Code of Republic of Moldova. As the result of the analysis, we recommend the legislator to use one in the mentioned articles the „because of hooligan reasons” formula instead of the „with hooligan intentions”. The hooligan intention is mentioned, first of all, in the case of hooliganism offences (art. 287 of the Criminal Code of Republic of Moldova) and the vandalism offences (art. 288 of the Criminal Code of Republic of Moldova). But the hooligan intention might also be at the basis of some offences that are not directed toward the public order. |
