In this article, are submitted for an analyses the crime delimitation criterions bounded with the drugs and its precursor traffic and with the persisting administrative contraventions referring to this subject. In this way, an important step is made in facilitating the characterization process of this deed, in many cases a very difficult process. There are examined the most frequent characterization errors, strongly connected with the penal and non-penal deeds delimitation. As well, it is recommended for improvement some legislative domain stipulations.
