Rezumat

The author of the article carries out a study on the concept of “offence recurrence” and it offers reasons in favor of its exclusion from the Criminal Code of Republic of Moldova. As a compensation to this exclusion, the author suggests the legislator to extend the effect of the “contest of offences” concept on the committing of two or more identical offences by the same offender. This will contribute to a better differentiation of the penal responsibility, to a more equitable establishment of the punishment, to a more consistent promotion of the goals and principles of the penal law and to the raising of the penal justice standards.
