Rezumat | ||||||
Pursuant the principle of relativity of the effects of civil juridical act, the juridical act produces effects in relation to its parties, without profiting from or prejudicing other entities. Consequently the effect of declaring the nullity of a juridical act will be reflected as a rule upon the parties of the envisaged act. Although the essence of nullity can be integrally expressed by means of the Latin adage quod nullum est, nullum producit effectum, this general principle however embodies in two rules of law which govern the effects of civil juridical acts in regard to parties: the principle of retroactivity and the principle of restoration to original condition (restitutio in integrum). Thus the elucidation of the issues concerning the effects of civil juridical acts’ nullity towards the parties implies a detailed analysis of these rules of law by emphasizing the exceptions from the application of these principles as provided by law, juridical doctrine and the judicial practice. |
