Rezumat

T he Directive 98/71/EC was the first document, wherein there were formulated the legal bases of the EC industrial design protection system. The integrated system of industrial design protection in the European Community became a reality on March 6, 2002, when the Regulations on Community Design Nr. 6/2002, the second legislative document governing the legal protection of industrial designs, entered into force. The legislation of the Republic of Moldova includes provisions sufficiently harmonized with the standards of the European Community. However, for an absolute harmonization of the legislation in the context of obligations deriving from the Agreement on Partnership and Cooperation between the European Community and the Republic of Moldova, it is necessary: to unify the notion of industrial design, industrial model, product and complex product; to introduce the criterion of individual character; to define the novelty of the complex product; to complete the grounds for exclusion from the protection or for cancellation of the registration; to stipulate the standards on forfeiture of rights in the industrial design; to complete the provisions on relations with other forms of protection.
