Статья посвящена анализу специфики отношений собственности, в частности анализа их субъектного состава на предмет участия в таких правоотношениях третьих лиц как самостоятельных субъектов гражданских правоотношений. Анализируя особенность таких правоотношений, автор исследует юридическую природу правовых связей, охватываемых субъективным правом собственности, состоящих при участии уполномоченных лиц и всех тех, на кого в силу специфики права собственности как одного из видов вещных прав, возлагаются обязанности пассивного характера. Сделан вывод о том, что отношения, которые охватываются правом собственности в силу своей специфики, не предусматривают правовых связей с участием третьих лиц как самостоятельных субъектов гражданских правоотношений. Кроме того, речь идет о необходимости отделения таких лиц, на которых в пределах исследуемого вида правоотношений возлагаются обязанности субъективного характера, от других лиц как участников гражданских отношений.

The article is sanctified to the analysis of specific of relations of property, in particular to the analysis of them subject composition for the purpose of participating in such legal relationships of the third persons as independent subjects of civil legal relationships. Analysing the specific of such legal relationships an author investigates legal nature of legal bonds, that is embraced by the equitable right of property, that consist of participation of the authorized persons and all those on that, in force of specific of the right of ownership as one of types of material rights, the duties of passive character are laid. Drawn conclusion, that relations that is embraced by the right of ownership in force of the specific do not envisage legal bonds with participation of the third persons, as independent subjects of civil legal relationships. In addition, speech goes also about a necessity dissociations of all other persons, on that within the limits of the investigated type of legal relationships the duties of subjective character are laid, from other persons as participants of civil relations.

Acest articol analizează specificul relațiilor de proprietate, în special, analiza compoziției subiect pentru participarea la astfel de relații juridice ale unor terțe părți ca subiecte independente ale relațiilor civile. Analiza caracteristică a acestor relații autorul analizează natura juridică a raporturilor juridice care fac obiectul dreptului subiectiv de proprietate, care constă cu participarea persoanelor autorizate, și toți cei care, din cauza drepturilor de proprietate specifice ca unul dintre tipurile de drepturi de proprietate, având în vedere responsabilitatea naturii pasive. Concluzia este făcută cu privire la faptul că relațiile sunt acoperite de dreptul de proprietate prin însăși natura lor, nu oferă raporturile juridice cu terțe părți ca subiecte independente ale relațiilor civile. În plus, o cerere de separare a unor astfel de persoane, care sunt în cadrul relațiilor specii investigate având în vedere responsabilitatea de natură subiectivă, de la alte persoane ca participanți la relațiile civile (art. 2 din Codul civil al Ucrainei).
