In the framework of the present article, the analysis of murder committed on two or more persons (lit.g) alin.(2) art.145 of the Penal Code of Republic of Moldova) is performed. In order to apply the aggravation in question, there should be met the following two conditions: the existence of multiplicity of victims; the perpetrator should manifest unique intent (doubled by a unique aim) to deprive of life two or more persons. There are presented arguments in support of the thesis that responsibility under art.27 and lit.g) par.(2) art.145 PC RM is applied in any of the following three specific cases, presuming the directly determined intention of the perpetrator regarding the number of murder victims: the perpetrator tried to deprive of life two or more persons, but none died; the perpetrator tried to deprive of life two or more persons, but died only one; the perpetrator tried to deprive of life two or more persons, but only two of them died. Rather, responsibility is applied depending on the actual outcome occurred, in case the perpetrator manifests indeterminable direct intention towards the number of victims and thus to the severity of prejudicial consequences. It is demonstrated why the intention of depriving of life two or more persons has to form either before the life deprivation of the first victims or during the process of undertaking the action (inaction) of life deprivation of the first victim. |
