This article is devoted to studying the similarities and differences with regard to the regulation of penal liability for trafficking of adults and trafficking of minors in the penal legislation of Republic of Moldova and Romania. It’s concluded that there are similar legislative previous precedents to the regulations stipulated in the Romanian Law nr.678 from 21.11.2001 on preventing and combating trafficking of human beings. That is par.2 art.329 PC Rom from 21.06.1968, as well as art.439 and 440 PC Rom from 1936. The purpose of practicing prostitution by the victim is not found among the forms carried by the purpose of the offense under art.1132 PC RM from 1961. Or, par.2 art.1132 PC RM from 1961 provides liability for the illegal trafficking of human beings perpetrated for sexual exploitation committed in different forms, except illegal trafficking of human beings for prostitution. Art.1052 “Pimping” of the Pena Code of Republic of Moldova from 1961 is one that includes the penalization of trafficking of human beings for prostitution purposes. In this regard, art.1052 PC RM from 1961 enhances similarities with art.329 PC Rom from 1968 |
