In this study, it is shown that the subjective side of the offenses under art.326 PC RM is characterized primarily by guilt as direct intention. It is also revealed that the reasons underlying the offense referred to in par.(11) art.326 PC RM are more diversified than the reasons which determine the offense specified at par.(1) art.326 PC RM. At the same time it is argued that in terms of art.326 PC RM, the phrase “for himself” denote the hypothesis when the influence peddler aims to gain personal satisfaction from obtaining or retaining a material or no material interest. Also, the phrase “for another” means that the influence peddler aims to ensure a material or no material interest for a third party, namely: 1) those related to the peddler, whose fate is of his concern; 2) people that may be useful in the future to the peddler, giving back some consideration to him.
