This article analyzes the nature and main stages of the criminal procedure in accordance with the legislation of the Russian Empire of the first half of the XIX century (before the judicial reform of 1864). The main attention is paid to such steps, as investigation, trial and execution. The reasons for which a preliminary investigation can begin are pointed out, the description of a formal investigation is given. Police held the investigation and executed the sentence. The article emphasizes that the theory of formal evaluation of the evidence had been continuing to apply in that period. All the
evidence was divided into perfect and imperfect. The most important place in the system of evidence took the own confession of the accused. Judicial inquiry as the trial stage did not exist. A guilty sentence could be passed only when there was perfect evidence. Legal proceedings were search, written and secret. |
