Rezumat

The manner of administration of a state has a leading role in the territorial administration and development. There is no ideal method of the way of territorial organization of a state. The territorial-administrative units are usually artificially created by the empowered state authorities. That’s why, the number varied from one to another period (even in the same state) and is different in each country. The territorial-administrative units are rather a consequence of the cultural, social, economic and political conditions, than an ad-hoc decision. The constitutions of the European countries, institutional and legal frame of each state assures the application of 5 basic principles that constitute the public local authorities: local autonomy; decentralization of the public services, eligibility of the public local authorities; administrative control of the activity of local authorities; consulting of the local authorities with their voters. The level of implementation of these principles and manner of application differ from state to state. In the specialty literature persist many opinions on the place and the role of territorial collectivities in the system of public administration. Without any differences between the federal and unitary structure of the state, its collectivities are compound of 2 or 3 levels. Therefore, no state is the only entrepreneur of the public services.
