In the framework of this study, there are examined the foreign legislators vision about the victim and the subject conception, about the methods of acts which increase prison disorganization, but, mostly, about the generic juridical object conception of the respective acts. Namely, even about the generic identity profile of the acts. It is managed the conclusion that only one from the foreign settlement models examined (The Albanian model) has at its foundation the same generic juridical object conception of the acts which increases prison disorganization, the same with the one promoted by the Moldova legislator. Eight from the foreign settlement models remind about the administrative order protection conception against the acts which increase prison disorganization. Other eight models are founded on the justice protection conception against the same acts. In the end, it is argued that the Romanian and the Malta’s settlement models differ through its eclecticism and discrepancy, founded on a different qualitative approach from the one introduced in the native penal law.
