Rezumat

The delimitation of the offence of hooliganism (art. 287 of the Criminal Code of Republic of Moldova) from some criminal and non-criminal adjacent deeds constitutes the subject of the present article. The problem of distinguishing the offence of hooliganism from some offences against the patrimony, mainly from the evasion (art. 186-188, 190-192 of the Criminal Code of Republic of Moldova) and from the deliberate destruction and deterioration of the goods (art. 197 of the Criminal Code of Republic of Moldova) remains especially up-to-date. Also, transparent criteria and scientific concepts of delimiting the hooliganism offence from the vandalism offence (art. 288 of the Criminal Code of the Republic of Moldova), from the offence provided by art. 285 „Mass disorders” of the Criminal Code, from the offences provided by art. 358 „the organization or the active participation in group actions that seriously disturb the public order or the involvement of under age persons in these actions” of the Criminal Code are identified. The present study of non-penal offences, takes into consideration certain deeds provided by the Code with regards to the administrative contraventions, in the Chapter 13 „Administrative contraventions that make attempt on the public order”, and the deeds provided by the Law of Republic of Moldova with regards to the hindrance of the extremist activity, adopted by the Parliament of Republic of Moldova on the 21st of February, 2003.
