Rezumat | ||||||
The study deals with a number of factors which would be responsible for the increased fragmentation of public international law, such as: the proliferation, regionalization and sectorization or specialization of international law, as well as self-contained regimes. All such factors would threaten the unity of the international legal system. The fragmentation has a dual effects, both the negative one and the positive too. The negative effects would constitute a threat to the reliability and credibility as well as effectivity of the system of international law. On the other hand, the positive effects are able to accommodates various needs and concerns of different states and that means a better compliance with international law, even increased harmonious regulations and the stability of international relations. At the same time, the proliferation and fragmentation might reveal the healthy and reflective power of the maturity of international law. |
