Rezumat | ||||||
The purpose of this article is to highlight the institutional differences between the court settlement and the out-of-court settlement. In the Republic of Moldova, the transaction is a contract governed by the provisions of the Civil Code, used as a tool to prevent or end a legal dispute, or to resolve difficulties arising during the execution of a court decision. At the same time, the Civil Procedure Code operates with the notion of transaction used in order to terminate a civil lawsuit. Through this research, we will notice what are the differences between the two institutions, and how they can be interconnected. |
