Regardless of the fact that the legislator normalized, in the 2nd and 3rd part of the 189th article of the Penal Code of Moldova, the content of physical violence as an aggravating circumstance in the case of blackmail, the terms “dangerous to life and health violence” and “riskless to life and health vio- lence”, still remain legal, but not medical concepts. To identify the specific content of these phrases, we could not omit causal interpretations, given by official subjects. However, through the overall analysis of these interpretations, we notice the absence of a unanimous idea regarding the sense of these no- tions. More than this, through the examples of law cases, that make an integral part of this study, we were convinced that in the practice area, the interpretations are far from uniform. Therefore, in order not to admit for the future any framing errors, we focused our scientific approach on the idea to determine the exact content of concepts of “dangerous to life and health violence” and “riskless to life and health violence”.
