The offence subject, prevented in the art.286 PC RM, is the responsible physical entity, of at least 14 years old at the time of perpetration of crime and fitting in the special quality of a person available to obey to the prison retribution. Affected by the existence of the operating disposal, to carry into the operating the prison conviction sentence, means that at that time the offender is able to obey to prison retribution. A person may be deprived of his capability to obey to prison retribution only if: the assigned retribution term has already exhaled; the offender is discharged of charges and the release motive is carried out into effect (as usual) or, after the ascertainment, when the authenticity of the releasing papers is confirmed, either the authenticity of the procedural document that constitute this motive is confirmed as well.
