Rezumat | ||||||
This article aims to highlight some positive obligations that Member States have under the European Convention on Human Rights regarding the detention of persons suffering from mental illness in preventive detention. As a matter of principle, they must be interned in special medical centers. Investigating magistrates who fail to order the internment are at risk of violating the Convention. Government’s omission to enforce means which eliminate systemic problems in this area may lead to the conviction of the Republic of Moldova before the European Court of Human Rights. |
