Raportat la dezbaterea actuală privind respectarea drepturilor fundamentale ale omului în procesul penal, acest articol încearcă să surprindă efecivitatea dreptului la un proces echitabil, mai exact – a dreptului la apărare de la momentul naşterii lui. Este analizată importanţa respectării obligaţiei de informare a acuzatului în procesul penal, prin prisma consecinţelor juridice care s-ar produce în situaţia încălcării dreptului de a fi informat al acuzatului cu privire la exercitarea efectivă a dreptului la apărare.

Referring to the current debate on respect for fundamental human rights in criminal proceedings, this article seeks to capture the effectiveness of the right to a fair trial, namely the right to defense at the time of its birth. It is examined the importance of respecting the obligation to inform the accused in the criminal proceedings, in the light of the legal consequences that would arise in the case of the violation of the right of the accused to be informed of the effective exercise of the right to defense.
