The question of differentiation of mental illness (Part 1 Article 121 of the Criminal Code), as grievous bodily harm over the severity of repeatedly examined the scientific writings of scholars in different times: lawyers and psychiatrists, and the complexity, ambiguity of the question - the inevitability of further study. The current Criminal Code of Ukraine (2001), in Article 121 criminalizes the intentional grievous bodily harm. Part 1 defines what the injuries are serious, in particular, states and mental illness
