Статья посвящена исследованию реализации одного из законодательно установленных профессиональных прав адвоката, а именно права на обращение с адвокатским запросом. Определено, что обращение с адвокатским запросом является важным рабочим средством адвоката для оказания квалифицированной правовой помощи; для получения и сбора доказательств в судебном процессе; а также для надлежащего выполнения адвокатом своих профессиональных обязанностей в целом. Проанализирована действующая нормативная база, регламентирующая вопросы, связанные с сущностью, формой, содержанием, законным порядком и условиями обращения адвоката с запросом к соответствующим компетентным субъектам, а также с юридической ответственностью за непредоставление ответа на запрос адвоката, неполное, несвоевременное предоставление такого ответа или предоставление недостоверного ответа. В данной статье автор предлагает внести конкретные законодательные изменения, направленные на укрепление механизма привлечения должностных лиц к ответственности за игнорирование адвокатского запроса, предоставление неполного или неправдивого ответа на него..  

The article is devoted to the investigation of the implementation of one of the legally established professional rights of advocate, namely the appeal of advocate’s request. It has been found out that the appeal of the request is an important tool of the attorney for the provision of qualified legal assistance; to obtain and collect evidences in the trial; and also for the proper performance by an attorney of his professional duties at all. The current regulatory framework has been analyzed, which regulates issues related to the essence, form, content, legal procedure and terms of the advocate’s request with a request to the competent subjects, as well as – with legal responsibility for failure to respond to the advocate’s request, incomplete, untimely provision of such response or provision of unreliable answer. In this article, the author proposes to introduce specific legislative changes aimed at strengthening the mechanism of bringing of ficials to account for ignoring the advocate’s request, providing an incomplete or untrue response to it

Articolul este dedicat cercetării punerii în aplicare a unuia dintre drepturile profesionale stabilite de un avocat, și anume dreptul de a se ocupa de cererea unui avocat. Se consideră că tratamentul solicitării unui avocat reprezintă un instrument important de lucru al unui avocat pentru acordarea asistenței juridice calificate; să obțină și să colecteze dovezi în proces; precum și pentru buna desfășurare de către un avocat a îndatoririlor sale profesionale în general. Analizat cadrul juridic existent care reglementează aspecte legate de natura, formulare, conținut, ordinea de drept și termenii de avocat de manipulare cererea entităților competente relevante, precum și - răspunderea juridică pentru eșecul de a răspunde la o solicitare de avocat, furnizarea incompletă, prematură a unui astfel de răspuns, sau să ofere răspuns fals. În acest articol, autorul propune modificări legislative specifice care vizează consolidarea funcționarii mecanismelor de responsabilizare pentru a ignora cererea unui avocat, furnizarea de răspuns incomplet sau neveridice
