În acest articol, sunt elucidate aspecte importante ale supreficiei, precum și tratarea particulară a atributelor acesteia. Identificând elementele constitutive ale superficiei și drepturile ce rezultă din acest regim special instaurat asupra bunului, au fost analizate aprofundat drepturile atât ale superficiarului, cât și ale proprietarului de teren. Este argumentată posibilitatea existenței unei superficii pe cote-părți, sunt investigate motivele apariției acesteia, formele de instaurare a unui astfel de drept real, precum și alte probleme ce pot apărea în acest sens. Autorul susține că divizarea atributelor componente ale superficiei pe cote-părți, la fel ca și drepturile și obligațiile ce rezultă din acesta, nu influențează asupra integrității dreptului real. Sunt identificate un șir de impedimente ce pot apărea în cazul aplicării unui astfel de regim, determinate de anumite carențe ale prevederilor art. 443 alin. (7) din Codul civil al Republicii Moldova. Au fost elaborate propuneri de lege ferenda în vederea perfecționării reglementărilor de drept civil în vigoare.

In this article are elucidated the important aspects of the superficies and the particular treatment of it’s attributes. Identifying the constitutive elements of the superficies and the rights that result from this special regime of the good, were deeply analyzed the rights and duties of the land owner and of the superficiary. There is brought to knowledge the possibility of existence of the superficies on shares, and there are elaborated the causes of it’s appearance, the methods of it’s initialization and also other the problems that could exist in this field. The author supports the idea that the division of the attributes of the superficies on shares and it’s rights and duties that result from this, do not affect the integrity of the real right. There are developed a row of problems that can appear during the application of this regime, caused by the present formulation at art. 443 paragraph (7) from the Civil Code of Republic of Moldova. There were proposed some ideas regarding the modification of the present civil provisions regarding this institution
