This article continues the analysis of regulations which establish the liability for offenses concerning trafficking of human beings in the Penal law of Republic of Moldova and Romania. It is shown that in the Penal Code of Republic of Moldova from 18.04.2002 is missing a similar norm to art.216 PC Rom from 2009. Only in some cases the use of services subject to exploitation of a trafficked person is under the provisions of the Penal Code of Republic of Moldova from18.04.2002. Because of the manner of characterization of the purpose of the offense at art.165 and 206 PC RM, the Penal Code of Republic of Moldova from 18.04.2002 is missing a norm such as art.182 PC Rom from 2009, where are to be submitted the forms to the purpose of exploitation on the trafficking of human beings offences. In another context, there is argued the opportunity to change the title of art.206 PC RM, so as to carry the junction “Trafficking of minors”. It is also stated that art.165 PC RM and art.210 PC Rom from 2009 should adopt a more appropriate title: “Trafficking of adults”. |
