Contractele de lucrǎri publice trebuie sǎ fie redactate de cǎtre specialişti datoritǎ complexitǎții serviciilor prestate prin contract şi riscului ivirii unor circumstanțe neprevǎzute în timpul executǎrii lucrǎrilor. Contractele Fеdеraţіei Іntеrnaţіonale a Іngіnеrіlor Сonѕultanţі (FIDIC – Fédératіon Іntеrnatіonalе Dеѕ Іngénіеurѕ-Сonѕеіlѕ) sunt o parte importantǎ a contractelor de achiziții publice de execuție lucrǎri, fiind puncte de referințǎ pentru majoritatea contractelor de achiziții. Contractele de lucrǎri, încheiate între operatorii economici şi autoritǎțile publice contractante, impun ca acestea sǎ fie redactate şi revizuite de cǎtre un avocat specializat în construcții, care cunoaşte şi înțelege regulile aplicabile lucrǎrilor publice. Public works contracts must be drawn up by specialists, granted the complexity of the services provided by the contract and the risk of unforeseen circumstances arising during the execution of the works. FIDIC contracts are a major part of public works contracts, as reference points for most procurement contracts. The works contracts concluded between the economic operators and the public contracting authorities require that they should be drafted and revised by a lawyer specialized in construction, who knows and understands the rules appropriate to public works. FIDIC contracts are standard contracts in the domain of construction and installation, internationally used as reference models. They were defined by the International Federation of Consulting Engineers (from where the acronym FІDІС – Fédératіon Іntеrnatіonalе Dеѕ Іngénіеurѕ-Сonѕеіlѕ) founded in 1915 by three European states (Belgium, France and Switzerland). Referring to building contracts, the goal of FІDІС was to create contract models to be used for a variety of building and installation projects, given the fact that, essentially, building anywhere around the world (aside technical and geographical specifications) follows the same guiding principles. These models cumulate decades of experience within building and installation projects and constitute documents taking into consideration in an equilibrated manner the interests of both side [1, p.44].
