The International Trade Law is dominated by the principle of full compensation of damage caused to the creditor by the breach of contract. The general rule is that the creditor is entitled to be put into the same position as he would have been had the debtor complied with the terms of his contract. The damages due to the creditor are the loss which he has suffered and the profit of which he has been deprived. In the present article we have analyzed the specific features of the said principle in various legal systems and instruments of uniform law: Viena Convention on the International Sale of Goods of 11 April 1980, UNIDROIT Principles regarding
the International Commercial Contracts and Principles of the European Contract Law. |
