T he industrial property protection legislation of the Republic of Moldova permits protection of products by several titles of protection. For the same product can be simultaneously issued two titles of protection: patent for invention or utility model certificate and industrial design certificate. Though both the inventions or utility models and the industrial designs are the result of an intellectual creative activity it is required to make a delimitation between them. When the form of a product is determined by its function, given the technical solution solving a technical problem, it shall be granted protection by a patent or a utility model. When the subject matter has an exclusively aesthetic aspect and its function is only an utilitarian one it shall be granted protection by an industrial design certificate. When the new aesthetic aspect of the form is separable from its function and it is also a generator of technical results, it can be protected by two titles of protection.
