In this article, it is determined that the place of abode is the immaterial object of the offence of trespas- sing. It is shown that the existence of an immovable property is insufficient, in order to be able to talk about the place of abode related to that property. There is further important that the space within that property to be effectively used, so that there could be attested the conduct of intimate life, family or private, even in a germinal form. Once the person connects sufficiently and in continuation with the space related to a property, that respective space obtains the quality of a space of abode. It is also argued that the meaning of the space of abode is to make possible the conduct of intimate, family and private life.
