В статье исследованы доктринальные подходы толкований содержания понятия «защита прав». Рассмотрены и проанализированы группы ученых, которые по-разному рассматривают содержание понятия «защита». Раскрыты основные теоретические подходы защиты прав акционерных обществ. Обосновано, что повышение интереса к изучению зарубежного опыта приведет положительные заимствования, которые могут способствовать для реализации и совершенствования законодательства по защите прав акционерных обществ в Украине. Определили и пришли к выводу, что роль государства является проявлением в распоряжении наиболее мощных сил и средств, которые формируются для обеспечения безопасности и защиты прав акционерных обществ, а также тем, что она является внешней средой функционирования самого акционерного общества, определяет основы функционирования, развития, обеспечения его безопасности.

The article explores doctrinal approaches to the interpretation of the concept of “protection of rights”. The groups of scientists who consider the content of the concept of “protection” in different ways are examined and analyzed. The basic theoretical approaches to protecting the rights of joint stock companies are disclosed. It is substantiated that an increase in interest in studying foreign experience will result in positive borrowings that can contribute to the implementation and improvement of legislation to protect the rights of joint stock companies in Ukraine. They determined and came to the conclusion that the role of the state is a manifestation at the disposal of the most powerful forces and means that are formed to ensure the safety and protection of the rights of joint stock companies, as well as the fact that it is the external environment for the functioning of the joint stock company itself, determines the foundations of functioning, development, ensure its safety.

Articolul explorează abordări doctrinare pentru interpretarea conceptului de „protecție a drepturilor”. Grupurile de oameni de știință care consideră conținutul conceptului de „protecție” în moduri diferite sunt examinate și analizate. Sunt prezentate abordările teoretice de bază pentru protejarea drepturilor companiilor pe acțiuni. Se demonstrează că o creștere a interesului pentru studierea experienței străine va duce la împrumuturi pozitive care pot contribui la implementarea și îmbunătățirea legislației pentru protejarea drepturilor companiilor pe acțiuni din Ucraina. Au stabilit și au ajuns la concluzia că rolul statului este o manifestare la dispoziția celor mai puternice forțe și mijloace care sunt formate pentru a garanta siguranța și protecția drepturilor companiilor pe acțiuni, precum și faptul că este mediul extern pentru funcționarea societății pe acțiuni și a determină bazele funcționării, dezvoltării, garantării siguranței acestora.
